Section 1 – General Provisions & Store Ownership

Throughout the site, the terms “we”, “us” and “our” refer to MITEK RETAIL MICHAŁ MITEK. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).
Section 2 – Nature of Business & Print-on-Demand Disclaimer

Cavisie.pl offers products inspired by the Cavalier King Charles Spaniel dog breed, including apparel, accessories, and custom-printed goods.

Print-on-Demand Product Disclaimer: All items available in the Store are custom-made, unique, and manufactured on-demand (Print-on-Demand) immediately after a customer places an order. Products are printed and fulfilled in cooperation with our production and fulfillment partner, Snapwear.pro, utilizing fulfillment facilities located in Dallas, Texas, USA, as well as Europe.

We make every effort to display the colors and images of our products as accurately as possible. However, we cannot guarantee that your computer monitor's or phone's display of any color will be completely accurate. Minor variations in print placement, color hue, and garment texture are natural characteristics of the digital print-on-demand process and do not constitute a product defect.
Section 3 – Order Placement & Modifications

By placing an order, you represent that you are at least the age of majority in your state or province of residence.

Because all items are custom-produced immediately upon order submission, orders are automatically routed to production. Therefore, requests for order cancellations, changes in size, color, design, or shipping address are not guaranteed once the order has been submitted.
Section 4 – Pricing, Sales Tax, and Payments

Prices for our products are subject to change without notice.

For US customers, prices listed on product pages exclude applicable state and local Sales Tax. Shopify automatically calculates and charges sales tax at checkout based on the delivery address and applicable state tax nexus regulations.

International customers (outside the US and EU) are solely responsible for any import duties, customs fees, or local taxes that may be levied upon the shipment's arrival in the destination country.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
Section 5 – Shipping, Delivery, and Fulfillment

Orders are processed, printed, and shipped from our fulfillment partner's facilities (including Dallas, TX for US orders).

Delivery Estimates: All shipping and delivery dates provided during checkout or in confirmation emails are estimates only and are not guaranteed.

We are not liable for any delays in delivery caused by shipping carriers (e.g., USPS, FedEx, DHL), weather conditions, customs clearance procedures, labor strikes, or any other events beyond our reasonable control.
Section 6 – No-Return & Refund Policy (Print-on-Demand)

ALL SALES ARE FINAL. Because our products are made-to-order and custom-printed specifically for you, we do not accept returns, refunds, or exchanges for buyer's remorse, accidental orders, or incorrect size selections. Customers are advised to carefully review the sizing charts provided on the product pages before purchasing.

This policy complies with applicable US commercial laws regarding custom-manufactured and made-to-order goods.
Section 7 – Damaged, Defective, or Wrong Items (Claims)

We take quality seriously. If you receive an item that is physically damaged, has a clear manufacturing defect, or if you received the wrong item/size due to a fulfillment error, we will gladly issue a free replacement or a refund.

To file a claim, you must contact us at zwroty@cavisie.pl within five (5) business days of receiving the package.

High-quality photos showing the full product, the specific defect/damage, and the shipping label on the packaging.

Do not mail any items back to our address or to the fulfillment center without prior written authorization from our support team. Unsolicited returns will not be processed or refunded.
Section 8 – Intellectual Property

All content included on this site, such as text, graphics, logos, button icons, images, digital downloads, unique Cavalier King Charles Spaniel artwork, and apparel design layouts, is the exclusive property of MITEK RETAIL MICHAŁ MITEK or its content suppliers and is protected by international copyright, trademark, and intellectual property laws.

Any unauthorized copying, reproduction, modification, distribution, or commercial exploitation of our designs, graphics, or content without express written permission is strictly prohibited.
Section 9 – LIMITATION OF LIABILITY (Crucial for USA)

IN NO EVENT SHALL MITEK RETAIL MICHAŁ MITEK, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS (INCLUDING SNAPWEAR.PRO) BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE.

MAXIMUM LIABILITY: BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE ACTUAL AMOUNT PAID BY YOU TO CAVISIE.PL FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
Section 10 – Indemnification
You agree to indemnify, defend and hold harmless MITEK RETAIL MICHAŁ MITEK and our partners (including Snapwear.pro), officers, directors, agents, and contractors from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.
Section 11 – Governing Law & Arbitration

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Dispute Resolution & Arbitration: You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or the use of the Store shall be settled by binding arbitration rather than in court.
Section 12 – Changes to Terms of Service
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
