Terms of Service (USA)

Welcome to Cavisie.pl – a store created out of love for the Cavalier King Charles Spaniel and great design. These Terms of Service govern your use of our online store and your purchases, including payments, shipping, claims, and intellectual property. Our store runs on Shopify.

Section 1 – Store operator

"We", "us", and "our" refer to MITEK RETAIL Michał Mitek.

Section 2 – Using the store

By using Cavisie.pl, you agree to these Terms of Service and our Privacy Policy. You confirm that you are at least the age of majority in your state of residence. To place an order, you need to provide accurate and complete information, including your name, shipping address, email address, and payment details.

Section 3 – Made-to-order products

Made to order: Our apparel and gifts are printed or embroidered on demand after you place your order.
US fulfillment: Orders shipped to US addresses are printed, packed, and shipped by our production partners in the United States.
Product appearance: We work hard to show colors, designs, and fabrics accurately. Small variations in print placement, color, and fabric texture can occur because of screen settings and the made-to-order process. These are not defects.
AI-generated images: Some photos and videos in our store, especially product photos and scenes with models and dogs, are visualizations generated or edited with artificial intelligence (AI). The people and dogs shown in these visualizations are not real people or animals. The print shown comes from the original design file we print on your order. Product details such as the blank, fabric, and sizes are defined by the product description and size chart.

Section 4 – Orders and changes

Placing an order is an offer to buy the selected products. The contract is concluded when we send you an order confirmation email.
Orders go into production quickly. We can change or cancel an order only before it goes into production. Please review your cart and address carefully before checkout.

Section 5 – Sizing

Every apparel product page includes a size chart in inches. Because each item is made to order, we don't keep stock for exchanges and can't refund or replace items ordered in the wrong size. Items that differ from our size chart by more than 1 inch are treated as defective (see Section 8).

Section 6 – Prices, payments, and sales tax

Prices on product pages are in US dollars and don't include shipping or sales tax.
Applicable state and local sales tax is calculated and collected at checkout based on your delivery address.
Payments are processed securely by third-party payment providers integrated with Shopify. We don't store or have access to your full card details.
We may change prices or run promotions at any time. Changes don't affect orders already confirmed.

Section 7 – Shipping and delivery

Delivery times and rates are described in our Shipping Policy. Delivery dates are estimates and are not guaranteed.
Risk of loss: Items are shipped under a shipment contract. Risk of loss and title pass to you when we hand the package to the carrier. We still replace or refund packages lost in transit as described in our Returns & Refunds Policy.
Delivered packages: We're not responsible for packages stolen after the carrier marks them as "Delivered".

Section 8 – Returns, refunds, and claims

All sales final: Because our products are made to order, we don't accept returns, exchanges, or refunds for change of mind, accidental orders, or the wrong size or color selected.
Damaged, defective, or wrong items: If your item arrives damaged, defective, misprinted, or not as ordered, email zwroty@cavisie.pl within 21 days of delivery with your order number and photos. Verified claims receive a free replacement or a full refund. You don't need to send the item back.
Unauthorized returns: Please don't send items to our business address or to our production partners without our written instructions. Such packages can't be matched to an order and can't be refunded.

Section 9 – Limitation of liability

THE SITE AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, EXCEPT AS EXPRESSLY STATED IN THESE TERMS. THIS DOESN'T LIMIT ANY WARRANTY OR RIGHT THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MITEK RETAIL MICHAŁ MITEK, ITS EMPLOYEES, AFFILIATES, AND CONTRACTORS (INCLUDING OUR PRODUCTION PARTNERS) ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE STORE OR ANY PRODUCT PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME STATES DON'T ALLOW THESE EXCLUSIONS OR LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Section 10 – Intellectual property

All content on Cavisie.pl – including text, images, logos, product designs, and Cavalier King Charles Spaniel illustrations – belongs to MITEK RETAIL Michał Mitek and is protected by copyright and trademark laws. You may not copy, reproduce, modify, or sell our designs without our prior written consent.

Section 11 – Reviews and photos

If you submit reviews, comments, or photos (for example, of your dog with our products), you give us a non-exclusive, royalty-free right to use and display them on our store and social media. We may remove content that is offensive, unlawful, or infringes third-party rights.

Section 12 – Governing law and disputes

These Terms and all purchases are governed by the laws of Poland, without regard to conflict-of-law rules. This does not take away any protection you have under the mandatory consumer laws of your state of residence.

Section 13 – Prohibited use and errors

You may not use the store for unlawful purposes, upload malicious code, scrape content automatically, or disrupt the store's operation. If a price or product information contains an error, we may correct it and will contact you before changing any affected order.
