Welcome to Cavisie.pl — a store created out of love for the Cavalier King Charles Spaniel breed and great design.
These Terms of Service govern your use of our online store, the placement of orders, payments, shipping, returns, claims, and the intellectual property available on the website. The Cavisie.pl online store is powered by Shopify infrastructure.

Section 2 – Use of the Store & Eligibility

By using Cavisie.pl, you agree to these Terms of Service and our Privacy Policy. You represent that you are at least the age of majority in your state or province of residence.

To place an order, you will be required to provide accurate, current, and complete details, including your full name, shipping address, email address, phone number, and payment details.
Section 3 – Print-on-Demand & Product Representations

Made-to-Order Process: Cavisie.pl offers custom-printed apparel, accessories, and gifts. Most of our products are manufactured utilizing Print-on-Demand (POD) technology immediately after an order is placed.

Local US Fulfillment: For customers located in the United States, our products are printed, packed, and shipped locally by our production partner, Snapwear.pro, from their fulfillment facilities in Dallas, Texas.

Product Appearance Disclaimer: We make every effort to display product images, descriptions, and colors as accurately as possible. However, minor variations in graphic placement, color vibrancy, and fabric texture may occur due to digital screen settings, lighting, or the specific digital textile printing process. These minor variations are normal and do not constitute a defect.
Section 4 – Order Placement & Modifications

Placing an order represents an offer to purchase the selected goods. A sales contract is finalized only when you receive an official order fulfillment confirmation email.

Immediate Production Queue: Because our system automatically routes custom orders directly to the production line at the Dallas facility, we cannot guarantee any order cancellations, changes, size adjustments, or address corrections after submission. It is your responsibility to review your cart thoroughly before finalizing the checkout.
Section 5 – Sizing Disclaimer
We provide detailed, explicit sizing charts on every garment product page. Because each item is custom-printed to order, we do not maintain an inventory for exchanges. We cannot issue refunds, store credits, or replacements for incorrect size selections made by the customer.
Section 6 – Pricing, Payments, and US Sales Tax

All prices listed on product pages exclude shipping costs and local taxes.

US Sales Tax: For US domestic purchases, applicable state and local sales taxes will be calculated dynamically and collected at checkout based on your delivery address and state tax regulations.

Payments are securely processed through third-party payment gateways integrated with the Shopify platform. We do not store or have access to your raw credit/debit card information.

We reserve the right to change prices or run promotions at any time. Price adjustments will not affect orders that have already been placed and confirmed.
Section 7 – Shipping & Delivery

Shipping terms, speeds, and carrier handoffs are explicitly detailed in our Shipping Policy. All delivery timelines provided are estimates only and are not strictly guaranteed.

Risk of Loss: All items purchased from Cavisie.pl are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the package to the shipping carrier (USPS, FedEx, DHL).

Stolen Packages: We are not responsible for packages that are stolen from your porch, mailbox, or property after they have been officially marked as "Delivered" by the shipping carrier.
Section 8 – Return & Refund Policy ("All Sales Are Final")

In accordance with US commercial standards for custom-manufactured and print-on-demand merchandise, ALL SALES ARE FINAL. We do not accept returns, exchanges, or refunds for buyer’s remorse, change of mind, or accidental orders.

Defective or Wrong Items: If you receive a product with a clear manufacturing defect (e.g., misprint, damage) or the wrong item entirely due to our error, you must contact zwroty@cavisie.pl within five (5) business days of delivery. You must provide high-quality photographic evidence of the item's defect along with a photo of the original shipping label. Verified claims will receive a free replacement or a full refund.

Unauthorized Returns: Do not return items to our mailing address or the fulfillment facility without written authorization. Unauthorized returns will be discarded and are not eligible for a refund.
Section 9 – LIMITATION OF LIABILITY (Essential US Legal Protection)

AS IS BASIS: THE SITE, SERVICE, AND ALL PRODUCTS DELIVERED TO YOU ARE PROVIDED (EXCEPT AS EXPRESSLY STATED BY US) ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

EXCLUSION OF DAMAGES: IN NO EVENT SHALL MITEK RETAIL MICHAŁ MITEK, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, OR CONTRACTORS (INCLUDING SNAPWEAR.PRO) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCTS PURCHASED THROUGH THE STORE.

MAXIMUM FINANCIAL CAP: IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE ACTUAL DOLLAR AMOUNT PAID BY YOU TO CAVISIE.PL FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
Section 10 – Intellectual Property

All content on Cavisie.pl—including text, images, logos, apparel layouts, unique Cavalier King Charles Spaniel illustrations, and promotional media—is the exclusive property of MITEK RETAIL MICHAŁ MITEK and is protected by international copyright, trademark, and intellectual property laws.

You are strictly prohibited from copying, scraping, reproducing, modifying, or commercially distributing our proprietary artwork or designs without our prior written consent.
Section 11 – User Reviews and Comments
If you submit reviews, comments, or photos of your dog with our products, you grant us a non-exclusive, royalty-free right to use, publish, and display that content for promotional purposes on our store or social media. We reserve the right to remove any content that is offensive, illegal, or infringes on third-party rights.
Section 12 – Governing Law & Binding Arbitration

Governing Law: These Terms of Service and any purchases made through the Store shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

Mandatory Arbitration: You agree that any dispute, controversy, or claim arising out of or relating to these Terms or your purchases shall be resolved through binding arbitration rather than in a court of law. You explicitly waive your right to participate in any class-action lawsuits or class-wide arbitrations.
Section 13 – Prohibited Activities & Errors

You are prohibited from using the site for unlawful purposes, transmitting viruses/malicious code, scraping content automatically, or attempting to disrupt the technical operations of the store.

Kluczowe modyfikacje, które wprowadziłem względem Twojej wersji PL:

Usunięcie 14/30 dni na zwrot (Section 8): W polskiej wersji oferujesz świetne warunki (14 dni ustawowo + 30 dni komfortowego zwrotu). W USA przy modelu POD to finansowe samobójstwo. Amerykańska polityka została zmieniona na "All Sales Are Final" – zwrot przysługuje wyłącznie wtedy, gdy Snapwear zrobi błąd (wada fabryczna lub zły produkt).

Zasada "Nie odsyłaj bez zgody" (Section 8 punkt 3): Klienci w USA mają nawyk odsyłania paczek na adres z etykiety (czyli do Dallas) albo do Ciebie do Polski. Wskazujemy jasno, że reklamacja odbywa się mailowo (na podstawie zdjęć) i nie wolno nic odsyłać "w ciemno", bo paczka przepadnie w sortowni Snapwear.

Limitation of Liability (Section 9 - Wielkie Litery): Dodany potężny amerykański "bezpiecznik". Blokuje on możliwość pozwania Cię o odszkodowania wyższe niż cena kupionego produktu (np. gdyby paczka z bluzą na prezent urodzinowy spóźniła się i klient żądał zadośćuczynienia za "stres").

Zastrzeżenie o kradzieżach paczek (Section 7 punkt 3): W USA plaga tzw. "Porch Pirates" (kradzieży paczek spod drzwi) wymaga jasnego zapisu, że w momencie gdy USPS/FedEx zmienia status na "Delivered", Ty nie odpowiadasz za to, co stanie się z paczką na ganku klienta.

Arbitraż zamiast sądów (Section 12): Zabezpieczenie przed pozwami zbiorowymi (Class Action), które są w USA bardzo popularne i kosztowne dla przedsiębiorców. Spory lądują w arbitrażu.
